Frequently Asked Questions
About Process Serving
Q: How long does it take?
A: Regular service averages 1-3
working days, and rush service
is same day or one hour.
Q: SHOULD I SERVE
ORIGINALS OR COPIES?
A: Normally, original documents
should not be served.
The original Summons must
be filed
with the court in order
to obtain
a default judgment.
Original subpoenas, discovery
requests,
ect. should be
retained in your files.
Q: HOW MANY COPIES SHOULD
I
PROVIDE FOR SERVICE?
A: If mailing or dropping off
documents,
you should provide
us with 2 copies
of each document
to be served per person.
Q: WHAT IS SUBSTITUTED
SERVICE AND
WHEN IS IT APPROPRIATE?
A: Substituted service
[(known as a "sub-serve"]
is acceptable when serving a
Summons,
Claim of Plaintiff,
Claim of Defendant,
Notice,
Writ of Attachment or
Writ of Execution.
It permits service by serving
someone other than the named
person and then mailing copies
of the
documents to the
person served.
Corporations may be sub-served
on the first attempt at serving.
Individuals, however may be
sub-served only after
due diligence is established
[usually by making at least
3 attempts].
Individual courts may have
stricter requirements for sub-service
which dictate the number of
attempts and times of the day
when attempts must be made.
Q: WHEN ARE WITNESS FEES
REQUIRED AND HOW
MUCH ARE THEY?
A: In general, witness fees are
payable anytime a witness is
required
to appear at a
deposition,
trial or hearing.
If you do not
provide a check
for witness fees, the
documents will be served
without them.
Q: What if the Address is bad?
Q: How many addresses
will you go to?
A: Our fee is per address.
We will attempt at as many
additional addresses as you want.
Q: How many times will
you go to
the address
to attempt service?
A: We will make up to
THREE (3) attempts
of service in Van Nuys.
Service in other cities will be on
a case by case basis.
Q: What happens if the person
or company can not be served
by the due date set by the court?
A: You will need to get the court
date reset and submit
a new request to our office.
Q: Do you do stake outs?
If so, where and when,
how much?
A: Yes, we are
Licensed Detectives,
St.Lic.#PI16819
we provide this service.
We do stake outs anywhere
throughout California,
24 hours a day, 7 days a week.
The fees are listed on our website.

Q: Do you file the proof of service
or affidavit?
A: Yes, we can do this.
An additional fee may apply.
Q: Do you provide a proof of service
or affidavit?
A: Yes, a professionally
written
document.
Q: Does the proof or affidavit
need to be notarized?
A: Only if you, or your State
requires a notarized signature.
Q: How many days do I have to get
my documents served?
A: Different Counties and States all
have
different rules,
consult the local
Court Clerk
or a representative
of our office.
Q: Do I need to prepay for
the service(s)?
A: YES, all services must
be pre-paid...
For substituted service:
The server tries to personally
serve the papers on the other
party
a number of times
(usually 3 or more) but cannot
find the party at home
(or work, if that is the
address the server has).
The server must try different days
of the week and different times
of the day,
at times when the
other person is likely to be home
(or at work if serving him or
her there).
If the server is unable to find
the person to be served on
each
one of those times,
he or she can, on the
last attempt,
leave the papers
with someone at the other
party’s house,
at least 18
years old, who lives there.
If the server is trying to
serve the papers at the
other party’s work,
then the papers can be
left with someone at the office
that appears to be in
charge and is at least 18 years old.
The server must tell the person
that he or she hands the papers
to that they are legal documents
for the other party.
The server must also write
down the name and address of the
person he or she gave the
Court papers to.
If the person will not give his
or her name, the server must
write down a detailed physical
description.
Next, the server
must mail a copy of the papers
to the other party
at the address
where the papers were left.
The server must then:
Write up a “Declaration of Due Diligence,”
which is document for the
Court
detailing every attempt he or she
made to serve the papers in person.
It should include the dates he or she
went to the house or work,
times of day, and what the result
was (for example,
“No one answered
the door” or “Party not in the office”).
The server has to sign this document
under penalty of perjury.
There is no form for this, but the
server can use a Declaration
(Form MC-030).
Your court’s self-help center may have
a local form to help you with this step too.
Fill out a Proof of Service, detailing when,
where, and how the papers were served.
The server has to make sure to write
the name of the person he or she left
the papers with
(or a detailed physical description).
The server signs the
(Proof of Service - Summons POS -010)
and returns it to you,
with the Declaration of Due Diligence,
to file in court.
Substituted service is complete
10 days after the day the papers are mailed.
NOTE: Sometimes, like in
small claims
cases, you can
use substituted service
the first time the server
tries to serve the
papers in person and
the other party
is not at home or work.
“Substituted service”
is not a very reliable
type of service
because the
Court
does not know for sure
that the person
that had to
be served
actually received the paperwork.

The Los Angeles Superior Court website allows for the initial
filing of Small Claims Cases online.
Once your filing is reviewed, fees are paid, and your electronic
documents are accepted by the Court,
your claim will
be filed with the appropriate courthouse as if you had filed in person.
How it works...
Step 1 - Complete the questions on this website and submit your claim
Upon receiving your claim information, the Court will send a Notice of Receipt of Documents
to the email address you provided. This notice contains your efiling ID number and
confirms that the Court has received your document(s).
(This notice does not mean that your claim has been processed or accepted by the Court)
Step 2 - Wait for the Court to either request payment or reject your filing
Upon receiving your document(s) electronically, the Court must review your claim to verify
that all filing criteria have been met. If your filing is determined to be valid, the Court
will email you a Notice of Payment Due that describes the fees associated with the
filing and the total amount that you are required to pay.
The Court will not accept any claim until payment has been made.
If payment is not made by the given due date, the filing will be rejected.
If your claim is rejected, the Court will email you a Notice of Rejection of Filing stating the
reasons why your claim was rejected. You will have (5) calendar days from the
date of the Notice of Rejection of Filing to correct and resubmit your claim.
If you fail to complete and resubmit your claim to the Court within those (5) calendar days,
your claim and any associated information will be deleted from this website and you will need to start over.
Step 3 - Pay any fees that are due by credit card
Log in to this website and look for your filing under the 'View Payment Due' menu option.
Once you have located and selected your filing, follow the instructions for
entering your credit card information and submit your payment.
Once the Court has received your payment, a Notice of Acceptance of Filing and a copy
of the processed documents will be sent to you by email for your records.
Once you receive this email, your filing has been accepted and
the initial filing of your small claims case is complete.
Please Note:
You may also have to arrange to serve the defendant(s) with notice
of the law suit after your initial claim filing has been accepted.
For all small claims matters filed in Van Nuys,
you must serve all named defendants with the
Los Angeles County Consumer & Business Affairs
Department's Online Dispute Resolution flyer.

What is efiling?
Efiling means electronic filing.
The eFiling website lets you fill out forms and file Small Claims online.
Your claim will be filed with the appropriate courthouse as if you had filed in person,
provided the information you supply is complete and the fees paid are correct.
A claim filed electronically from this website has the same legal effect as a claim in paper form.
Filing a claim electronically does not alter or extend any filing deadline.
A claim filed electronically with the Court after the close of business is
considered to have been filed on the next Court day.
For current business hours, contact the appropriate Court location.
What is required to use efiling?
How do I start and what information
do I need to file Small Claims
using the LASC website?
To use the efiling site, you must register an account with the Court.
To register, you need the following:
What is an authorization code?
What documents may I
file electronically on this site?
How much does it cost?
In addition to the regular filing fees, you will pay an Efiling Service Provider Fee.
This fee reimburses the Court for providing electronic public access services.
Currently, you cannot file the application for Waiver of Court Cost and Fees electronically.
If you are eligible for and seek a Waiver of Court Costs and Fees,
you must file your case documents in person at the appropriate courthouse.
Can I pay with a check?
No. To use this website, you must pay for all required fees
with a valid credit card (currently Visa, MasterCard or Discover).
May I pay in advance for
multiple filings?
No. Each filing must be charged individually.
How do I retrieve my
lost/forgotten password?
If you’ve misplaced your password, click on the “forgot you password”
link under the “Log In” section of the home page.
The site will require you to input your e-mail address registered with this site.
The site will forward a new password to your e-mail account.
Is the LASC website secure?
The Los Angeles Superior Court maintains a high standard of security
on its website. This site uses a full
128-bit encryption, ensuring that confidential information,
e.g., names, passwords, credit card numbers, etc., remains secure.
Can I save an incomplete claim
and return to it later?
Yes. You have up to five (5) calendar days to complete
and submit your claim on this website.
If you are unable to complete the process once you begin,
you can stop and return to access it again during these five calendar days
with your information saved.
Any claims that are not completed within that
period of time will be deleted.
To save an incomplete claim, click on the
'Save & Exit' button found near the bottom of the screen you're working on.
To resume, you must log in. From the 'My Efiling' screen,
select 'Resume Incomplete Claims' then click on the 'Submit' button.
After completing a claim,
how do I complete additional
claims without re-logging in?
Click on the 'File a New Claim' option in the main navigation menu
located on the left hand side of the screen, re-agree to the efiling terms
and conditions, and begin answering the claim questions for your new claim.
What can I expect after submitting
my claim via this site?
After you complete the questions on this website and submit your claim electronically,
the Court will send a Notice of Receipt of Documents to the e-mail address you provided.
If the Court accepts your claim, your credit card will be charged for the fee amount
you agreed to pay.
The Court will e-mail you a Notice of Acceptance of Filing and a
copy of the processed filing documents
for your records. You can only consider your
claim completed when you have received the Notice of Acceptance of Filing.
If your claim is rejected, the Court will e-mail you a Notice of Rejection
of Filing stating why your claim was rejected, and will not charge your
credit card. If your claim is rejected, you will have five (5) calendar days from
the date of the
Notice of Rejection of Filing to correct electronically and resubmit your
claim to the Court using this website. If you do not complete and resubmit
for filing within those five calendar days,
your incomplete/rejected
claim and any information previously provided will be deleted from this website.
If I file my claim late in the day,
will it count as being filed that same day?
My question is not answered here.
Is there another way I can
get my question answered?
