SUBSTITUTE SERVICE
OF
LEGAL PROCESS

 

For substituted service:


The server tries to personally
serve the papers on the other
party a number of times
(usually 3 or more) but cannot
find the party at home
(or work, if that is the
address the server has
).
The server must try different days
of the week and different times
of the day, at times when the
other person is likely to be home
(or at work if serving him or
her there
).
If the server is unable to find
the person to be served on
each one of those times,
he or she can, on the
last attempt, leave the papers
with someone at the other
party’s house, at least 18
years old, who lives there.
If the server is trying to
serve the papers at the
other party’s work,
then the papers can be
left with someone at the office
that appears to be in
charge and is at least 18 years old.
The server must tell the person
that he or she hands the papers
to that they are legal documents
for the other party.
The server must also write
down the name and address of the
person he or she gave the
Court papers to.
If the person will not give his
or her name, the server must
write down a detailed physical
description. Next, the server
must mail a copy of the papers
to the other party at the address
where the papers were left.

The server must then:

Write up a “Declaration of Due Diligence,”
which is document for the Court
detailing every attempt he or she
made to serve the papers in person.
It should include the dates he or she
went to the house or work,
times of day, and what the result
was (for example, “No one answered
the door” or “Party not in the office
”).
The server has to sign this document
under penalty of perjury.
There is no form for this, but the
server can use a Declaration
(Form MC-030).
Your court’s self-help center may have
a local form to help you with this step too.
Fill out a Proof of Service, detailing when,
where, and how the papers were served.
The server has to make sure to write
the name of the person he or she left
the papers with
(or a detailed physical description).
The server signs the
(Proof of Service - Summons POS -010)
and returns it to you,
with the Declaration of Due Diligence,
to file in court.

 

 

  1. Substituted service is complete
    10 days after the day the papers are mailed.

The Los Angeles Superior Court website allows for the initial
filing of Small Claims Cases online.

Once your filing is reviewed, fees are paid, and your electronic
documents are accepted by the Court, your claim will
be filed with the appropriate courthouse as if you had filed in person.




Please Note: You cannot file your claim on this website if any of the following are true:




How it works...


Step 1 - Complete the questions on this website and submit your claim

Upon receiving your claim information, the Court will send a Notice of Receipt of Documents
to the email address you provided. This notice contains your efiling ID number and
confirms that the Court has received your document(s).

(This notice does not mean that your claim has been processed or accepted by the Court)

 

 

Step 2 - Wait for the Court to either request payment or reject your filing

Upon receiving your document(s) electronically, the Court must review your claim to verify
that all filing criteria have been met. If your filing is determined to be valid, the Court
will email you a Notice of Payment Due that describes the fees associated with the
filing and the total amount that you are required to pay.
The Court will not accept any claim until payment has been made.
If payment is not made by the given due date, the filing will be rejected.

If your claim is rejected, the Court will email you a Notice of Rejection of Filing stating the
reasons why your claim was rejected. You will have (5) calendar days from the
date of the Notice of Rejection of Filing to correct and resubmit your claim.
If you fail to complete and resubmit your claim to the Court within those (5) calendar days,
your claim and any associated information will be deleted from this website and you will need to start over.

 

 

Step 3 - Pay any fees that are due by credit card

Log in to this website and look for your filing under the 'View Payment Due' menu option.
Once you have located and selected your filing, follow the instructions for
entering your credit card information and submit your payment.

Once the Court has received your payment, a Notice of Acceptance of Filing and a copy
of the processed documents will be sent to you by email for your records.
Once you receive this email, your filing has been accepted and
the initial filing of your small claims case is complete.


 

Please Note:

You may also have to arrange to serve the defendant(s) with notice
of the law suit after your initial claim filing has been accepted.

What is an authorization code?


Upon completion of registration,

The Authorization Code ensures the Court that your e-mail address is valid.

Can I save an incomplete claim
and return to it later?


Yes. You have up to five (5) calendar days to complete
and submit your claim on this website.
If you are unable to complete the process once you begin,
you can stop and return to access it again during these five calendar days
with your information saved. Any claims that are not completed within that
period of time will be deleted. To save an incomplete claim, click on the
'Save & Exit' button found near the bottom of the screen you're working on.
To resume, you must log in. From the 'My Efiling' screen,
select 'Resume Incomplete Claims' then click on the 'Submit' button.



After completing a claim,
how do I complete additional
claims without re-logging in?


Click on the 'File a New Claim' option in the main navigation menu

the Court will send a Notice of Receipt of Documents to the e-mail address you provided.
If the Court accepts your claim, your credit card will be charged for the fee amount
you agreed to pay. The Court will e-mail you a Notice of Acceptance of Filing and a
copy of the processed filing documents for your records. You can only consider your
claim completed when you have received the Notice of Acceptance of Filing.

If your claim is rejected, the Court will e-mail you a Notice of Rejection
of Filing stating why your claim was rejected, and will not charge your
credit card. If your claim is rejected, you will have five (5) calendar days from
the date of the Notice of Rejection of Filing to correct electronically and resubmit your
claim to the Court using this website. If you do not complete and resubmit
for filing within those five calendar days, your incomplete/rejected
claim and any information previously provided will be deleted from this website.



If I file my claim late in the day,
will it count as being filed that same day?

 

A document that is received electronically with the Court
after the close of business is considered to have been filed on the next
Court day. Currently, the Court closes for business at 4:30 p.m,
Monday through Friday, except Court holidays.
